Who We Are
The Websites are operated by Premaha Pvt Ltd, which includes Premaha and any other affiliated entities and subsidiaries, all of which are holders of your personal information. Further, “Social Media Pages” are the official social media pages we operate on social media platforms such as Facebook, Instagram, YouTube, Twitter, LinkedIn, and other social media platforms.
Why This Privacy Policy
This Privacy Policy is published in compliance with, inter alia:
1. Section 43A of the Information Technology Act, 2000;
2. Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
This Privacy Policy states the following:
1. The type of information collected from the Users, including Personal Information and Sensitive Personal Data or Information relating to an individual;
2. The purpose, means, and modes of collection, usage, processing, retention, and destruction of such information; and
3. How and to whom Premaha will disclose such information.
Collection of Personal Information
This Privacy Policy covers the collection and processing of your personal data. Where this Privacy Policy refers to ‘personal data,’ it is referring to data about you from which you could be identified – such as your name, your date of birth, your contact details, and even your IP address.
The personal data we collect from you may include:
– Identity Data: which includes your full name, date of birth.
– Contact Data: which includes your billing address, delivery address, email address, and telephone number. When you message a Practitioner through the website, they will receive your message and email address.
– Financial Data: which includes bank account and payment card details.
– Transaction Data: which includes details about payments to and from you and other details of services you have purchased from us.
– Technical Data: which includes your IP address, operating system, browser type, browser version, time zone setting, and location.
– Profile Data: which includes your username and password, purchases or orders made by you, your website browsing history, demographic information such as age, gender, education level, and any information that you have made publicly available on our noticeboards and social media networks. We will also capture your interests, preferences, feedback, and survey responses. If you’re a practitioner, we will capture information about your work, photographs, biography, treatments offered, and languages spoken by Practitioners, average rating obtained from our evaluation using algorithms of ratings review, feedback survey results, and any other information you willingly provide.
– Assessment Data: information on qualifications and certification of Practitioners, contact logs data, performance, and ratings data.
– Health Information: We may collect certain health-related information that you provide to us in connection with the products and services we make available to you.
– User Feedback: By using this Website, you are agreeing that We may advertise your feedback on the Website and marketing materials.
– Data Retention: We will retain your information as long as we require this to provide you with the goods and services and for such period as mandated by the laws concerned.
– Marketing Communications: If you opt to receive marketing correspondence from us, subscribe to our mailing list or newsletters, enter into any of our competitions, or provide us with your details at networking events, we may use your personal data for our legitimate interests in order to provide you with details about our goods, services, business updates, and events.

– Operational Data: including interaction with the Services and transcripts from calls, messages from “live chats” with all users of the site, including Users and Practitioners.
– Transaction Data: includes details of the Products and Services you have purchased from the website or app.
– Usage Data: information about how you use the Services. This includes how you interact with the Services, for example, how long you engage with Premaha at a time, how often a booking is made, and which parts of the Services you interact with and the features you use.
– Work-Related Data: We work with businesses to deliver our Services to their employees. If you are employed by one of those businesses, to use the Services you will need to sign up with us. We will collect information from you directly when you do this; we will also be able to associate this with information provided by your employer, such as your job title.
– Service Notes: we may collect information about our Service delivery, for example, instructions on how to access a building, address details, and email address details. You provide this information voluntarily. We pass this information on to the Practitioner and/or Client so that they can understand any specific access/similar requirements.

We may gather information directly from you, from trusted third-party partners, or through cookies and other automated tools. These sources include:
You: We collect information you provide when you visit our Websites, send us emails with inquiries, fill out our forms, upload content, create an account, subscribe to marketing communications or email alerts, attend events, participate in programs, interact with our employees and advisors, make purchases, respond to surveys, leave reviews, or engage with or “like” our Social Media Pages. You may also share details about your preferences, interests, and other general information.
Your Device or Browser: Certain details are automatically gathered from your device or browser whenever you visit our Websites, interact with our Social Media Pages or online ads, or open our emails. We analyze this information to understand how you engage with our content.

Practitioners: When you make a booking via the Website or the Premaha Services, our practitioners may process your personal data on our behalf as one of our Service Providers. However, if you seek our practitioners’ services without our involvement, then you understand that they will be processing your personal data as an independent data controller, and we shall have no control, nor have any responsibility or liability in respect of their use of your personal data.
Business Transfers: If (i) we or any of our affiliates undergoes a business transition or change of ownership, such as a merger or acquisition by another entity, or (ii) if any of our assets are or may be transferred to another entity, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may be required to disclose or transfer the personal information we have collected from you. As part of the business transfer process, we may share certain of your personal information with lenders, auditors, and third-party advisors, including attorneys and consultants.
Safety: We may review, scan, or analyse your communications on the website between the User and the Service provider and/or Practitioner for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, analytics, and customer support purposes. These activities are carried out based on legitimate interest in ensuring compliance with applicable laws and our Terms, preventing fraud, promoting safety, and improving and ensuring the adequate performance of our services.
Other Third Parties: We may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Company; (b) protect and defend the rights or property of Company; and, (c) act under exigent circumstances to protect the personal safety of users of Company or the public.

– To protect the rights and property of Us, our agents, customers, and others including to enforce our agreements, policies, and terms of use.
The above-mentioned information will be protected in accordance with RIGHTS AND DUTIES OF DATA PRINCIPAL of Digital Personal Data Protection Act 2023 & at the time of request, summon, or any other communication by Government of India, Hon’ble & Officers will be shared with them.
Information You May Collect as a User or Practitioner
If you are a Practitioner, you are responsible for ensuring that you comply with applicable data protection law in respect of any personal information that you collect about Users in the course of your provision of the Services. Premaha does not accept any responsibility for this processing of personal data.
If you are a User, you are responsible for any misuse of personal information that you may collect in the course of your receipt of the Services. Premaha does not accept any responsibility for this processing of personal data.
Company’s Service Providers
We carefully vet all service providers we work with to ensure they maintain strong data protection and information security standards. We only share the personal data necessary for them to perform the services requested. In some instances, these third parties may use the data they collect for their own purposes, such as combining your data with other information they have to enhance their offerings. Our service providers must meet stringent requirements outlined in our contracts, including strict limits on how long they can retain your data.
Sale or Sharing of Personal Information
We do not sell your personal information in exchange for monetary compensation. We may disclose your personal information by allowing certain third parties (such as social networks and online advertising services) to collect your personal information via automated technologies on our Websites for social networking and cross-context behavioural advertising purposes. We take steps to help protect the confidentiality and security of your information. We pride ourselves on taking all appropriate security measures to protect your information against loss, misuse, and unauthorized access, or disclosure. We use reasonable security measures to safeguard the confidentiality of your personal information, such as secured servers using firewalls. Premaha also assists the practitioners to maintain and organise such information. Premaha may, therefore, retain and submit all such records to the appropriate authorities, or to doctors who request access to such information.
The proper way of Premaha is assisting the clients to access information relating to them. Premaha may, therefore, retain and submit all such records to the relevant clients, or to their practitioners.
If the User is accessing couples sessions or family sessions, the Wellness Professional may disclose Personal Information to the User’s partner or family respectively in service of ethical treatment.
Security
Premaha takes the protection of your information very seriously. Where we have given you a password that enables you to access certain parts of our Website or the Premaha Services, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
Your Rights
As a valued User of Premaha, you have several important rights regarding your User Information. You have the right to seek confirmation and access to how your information is being processed, ensuring transparency and trust. If you notice any inaccuracies in the information you’ve shared, please let us know so we can correct it promptly. Should you wish to limit or stop the collection and use of your information, you have the right to request this, and we’ll respect your wishes. Additionally, if you have any concerns or grievances about how your information is handled or used, we are here to listen and address them with care and attention. In the unfortunate event of your death or incapacity, you can even nominate someone to exercise your rights on your behalf. Just send us an email, and we’ll guide you through the process. At Premaha, we are committed to ensuring that your experience with us is both secure and respectful.
Data Retention and Deletion
We will retain your personal information only as long as we need it to achieve the purposes of this Privacy Policy, or other notices that are provided at the time of collection, taking into account applicable statutes of limitation and records retention requirements under applicable law.
Children
If you are under 18, or the age of majority in the jurisdiction in which you reside, these tools also can prevent minors from disclosing their name, address, and other personally identifiable information online without parental permission. In any case, We will not be liable for any cause of action that arose due to non-compliance with this section.

Governing Law & Dispute Resolution
At Premaha, we aim to handle any differences with care and respect. Our Terms will be governed by the laws of India. Should any disputes arise between Premaha and our users regarding these Terms, we will seek to resolve them through a fair and collaborative process. Disputes will be referred to a single Arbitrator, chosen together by both parties. If we can’t agree on an Arbitrator, we’ll follow the procedures set out in the Arbitration and Conciliation Act, 1996, to appoint one.
The arbitration will take place in New Delhi, and the proceedings will be conducted in English. We’ll share the costs of arbitration equally, apart from each party’s own legal fees. The Arbitrator’s decision will be final and binding. Should it be necessary, the courts in New Delhi will have exclusive jurisdiction to handle any legal matters related to the Terms.
Miscellaneous
The obligations and promises set forth in this Privacy Policy are deemed sufficient, and its validity cannot be disputed due to a lack of monetary consideration. If either party does not enforce a particular provision or seek legal remedies, it does not mean they forfeit the right to do so later. If a court finds any part of this Privacy Policy invalid or unenforceable, the other parts will remain in effect, and the invalid portion will be interpreted as permitted by law.
This Policy creates a direct relationship between Premaha and you; it does not establish a partnership, association, joint venture, agency, or employer-employee relationship. You may not assign your rights under this Policy without our prior written consent, but we may assign this Policy to a third party at our discretion.
All notices under this Policy must be in writing and sent by email or registered mail (postage prepaid with return receipt). Notices will be considered delivered once received. Communications to Premaha should be directed to the grievance officer, and communications to you will be sent to the email address you provided at registration.
We are not responsible for delays or failures caused by events beyond our control, such as hacking, malware, internet outages, server issues, strikes, labor disputes, lockouts, war, terrorism, riots, natural disasters, epidemics, pandemics, or government actions or restrictions.
This Policy constitutes the entire agreement between Premaha and you, and replaces any previous agreements. Any changes, amendments, or waivers to its terms must be made in writing and signed by both parties or their authorized representatives to be valid and effective.
